Terms & Conditions

Welcome to Handgelaat. These Terms & Conditions apply whenever you browse, order from, or otherwise use the Handgelaat website. Please read them alongside our Privacy Policy and our Returns & Refunds Policy. By placing an order with us, you agree to these terms.

Nothing in these Terms & Conditions takes away any right you have under South African consumer law, including the Consumer Protection Act and the Electronic Communications and Transactions Act. Where any part of these terms conflicts with a right you have under South African law, the law takes precedence.

1. Who we are

Handgelaat (Pty) Ltd, registration number 2026/577784/07, is a South African online leather and home goods brand. Our registered address is 7 Chanzelle Complex, St Georges Street, Denneoord, George, Western Cape, 6529, South Africa. All products sold by Handgelaat are handmade. Some pieces are handcrafted by Handgelaat ourselves, while others are carefully selected from South African makers and suppliers we trust. We don't claim that every product is made by us, but every piece we sell is genuinely handmade.

2. Orders and availability

When you place an order, you're making an offer to buy the product(s) in your cart. We'll send you an order confirmation, but this doesn't guarantee availability - occasionally, and particularly with handmade and made-to-order pieces, an item may sell out or become unavailable after you've ordered. If this happens, we'll contact you as soon as we can to offer a replacement, a wait, or a full refund.

We reserve the right to decline or cancel an order, for example where there's a pricing error, suspected fraud, or a product is genuinely unavailable. If we cancel an order you've paid for, we'll refund you in full.

3. Prices and payment

All prices on our website are shown in South African Rand (ZAR) and include VAT where applicable, unless stated otherwise. Prices may change from time to time without prior notice, but the price that applies to your order is the price shown at the moment you place it. We try our best to make sure prices are accurate, but if a genuine pricing error occurs, we'll contact you before processing your order.

Payment is processed securely through Shopify's checkout system. We do not store your card details ourselves - this is handled by Shopify and its payment partners.

4. Personal use

Our products are sold for personal use. If you'd like to stock Handgelaat pieces in a shop, or order in larger quantities for resale or corporate gifting, we'd love to hear from you - please contact us at heidi@handgelaat.co.za so we can arrange it properly.

5. Checkout

All orders are placed and paid for through Shopify's secure checkout. Shopify remains our checkout and payment platform, and your payment details are handled entirely within that secure environment.

6. Delivery

Please see our Shipping & Delivery page for details on delivery timeframes and fees. Delivery times are estimates and can be affected by courier conditions outside our control.

7. Returns and defective or incorrect products

Our full returns process, including your statutory cooling-off rights and the 10% handling fee that applies to change-of-mind returns, is set out in our Returns & Refunds Policy. If a product arrives damaged, defective, or different from what you ordered, please contact us at heidi@handgelaat.co.za and we will work with you to put it right, in line with your rights under South African consumer law.

8. Personalised products

Selected products can be personalised with a name, date, initials or short message. You are responsible for checking all names, dates, spelling and wording you supply for personalisation before submitting your order - we make these exactly as instructed. If we make an error in the personalisation you agreed with us, we will take responsibility for correcting it at our cost.

Because personalised and made-to-specification items are made especially for you, they may be excluded from the ordinary statutory cooling-off right where South African law permits this. This does not remove your rights where the item is defective, incorrectly personalised by us, or doesn't match what you ordered.

9. Handmade products and natural materials

All Handgelaat products are handmade - some by us, and some by the South African makers and suppliers we've chosen to work with. Leather, wood and other natural materials are living materials. They can include natural grain, colour variation, scars, markings, knots and texture differences. These characteristics, and the small variations that come with handmade production, are part of what makes each piece unique - they are not automatically defects.

10. Sale and promotional products

Products bought on sale or with a promotional discount remain subject to these Terms & Conditions and your statutory consumer rights in full, including your rights relating to defective, unsafe or incorrectly supplied goods.

11. Privacy

We take your privacy seriously. Please see our Privacy Policy for full details on what personal information we collect, why, and how we protect it.

12. Marketing consent

We will only send you marketing communications (such as emails about new products or promotions) if you've given us your consent to do so. You can withdraw this consent at any time - see our Privacy Policy for how.

13. Intellectual property

All content on this website - including our name, logo, product photography, descriptions and design - belongs to Handgelaat (Pty) Ltd or our suppliers, and may not be copied or reused without our permission.

Diensvoorwaardes

Welkom by Handgelaat. Hierdie Bepalings en Voorwaardes geld wanneer jy die Handgelaat-webwerf besoek, daarvan bestel, of dit andersins gebruik. Lees dit asseblief saam met ons Privaatheidsbeleid en ons Terugstuur- en Terugbetalingsbeleid. Deur 'n bestelling by ons te plaas, stem jy in tot hierdie voorwaardes.

Niks in hierdie Bepalings en Voorwaardes neem enige reg weg wat jy ingevolge Suid-Afrikaanse verbruikerswetgewing het nie, insluitend die Verbruikersbeskermingswet en die Wet op Elektroniese Kommunikasie en Transaksies. Waar enige deel van hierdie voorwaardes bots met 'n reg wat jy ingevolge Suid-Afrikaanse wetgewing het, geniet die wet voorrang.

Ons geregistreerde adres is 7 Chanzelle Complex, St Georgesstraat, Denneoord, George, Wes-Kaap, 6529, Suid-Afrika. Alle produkte wat deur Handgelaat verkoop word, is handgemaak. Sommige stukke word deur Handgelaat self met die hand gemaak, terwyl ander noukeurig gekies word van Suid-Afrikaanse makers en verskaffers wat ons vertrou. Ons beweer nie dat elke produk deur ons gemaak is nie, maar elke stuk wat ons verkoop, is werklik handgemaak.

2. Bestellings en beskikbaarheid

Wanneer jy 'n bestelling plaas, maak jy 'n aanbod om die produk(te) in jou mandjie te koop. Ons stuur vir jou 'n bestellingsbevestiging, maar dit waarborg nie beskikbaarheid nie - soms, en veral met handgemaakte en spesiaal-gemaakte stukke, kan 'n item uitverkoop of onbeskikbaar raak nadat jy bestel het. Indien dit gebeur, kontak ons jou so gou moontlik om 'n plaasvervanger, 'n wagtyd, of 'n volle terugbetaling aan te bied.

Ons behou die reg voor om 'n bestelling te weier of te kanselleer, byvoorbeeld waar daar 'n prysfout is, bedrog vermoed word, of 'n produk werklik onbeskikbaar is. Indien ons 'n bestelling kanselleer waarvoor jy betaal het, betaal ons jou ten volle terug.

3. Pryse en betaling

Alle pryse op ons webwerf word in Suid-Afrikaanse Rand (ZAR) gewys en sluit BTW in waar van toepassing, tensy anders vermeld. Pryse kan van tyd tot tyd verander sonder vooraf kennisgewing, maar die prys wat op jou bestelling van toepassing is, is die prys wat gewys word op die oomblik dat jy dit plaas. Ons doen ons bes om te verseker dat pryse akkuraat is, maar indien 'n werklike prysfout voorkom, kontak ons jou voordat ons jou bestelling verwerk.

Betaling word veilig deur Shopify se betaalstelsel verwerk. Ons stoor nie self jou kaartbesonderhede nie - dit word deur Shopify en sy betaalvennote hanteer.

4. Persoonlike gebruik

Ons produkte word vir persoonlike gebruik verkoop. Indien jy Handgelaat-stukke in 'n winkel wil aanhou, of in groter hoeveelhede wil bestel vir herverkoop of korporatiewe geskenke, hoor ons graag van jou - kontak ons asseblief by heidi@handgelaat.co.za sodat ons dit behoorlik kan reël.

5. Betaalpunt

Alle bestellings word geplaas en betaal deur Shopify se veilige betaalpunt. Shopify bly ons betaalpunt- en betaalplatform, en jou betaalbesonderhede word heeltemal binne daardie veilige omgewing hanteer.

6. Aflewering

Sien asseblief ons Versending- en Afleweringsbladsy vir besonderhede oor afleweringstye en -fooie. Afleweringstye is skattings en kan beïnvloed word deur koeriertoestande buite ons beheer.

7. Terugstuurings en gebrekkige of verkeerde produkte

Ons volledige terugstuurproses, insluitend jou statutêre afkoelregte en die 10% hanteringsfooi wat geld vir terugstuurings waar jy van plan verander het, word in ons Terugstuur- en Terugbetalingsbeleid uiteengesit. Indien 'n produk beskadig, gebrekkig of anders as wat jy bestel het aankom, kontak ons asseblief by heidi@handgelaat.co.za en ons sal saam met jou werk om dit reg te maak, in lyn met jou regte ingevolge Suid-Afrikaanse verbruikerswetgewing.

8. Gepersonaliseerde produkte

Geselekteerde produkte kan gepersonaliseer word met 'n naam, datum, voorletters of kort boodskap. Jy is verantwoordelik om alle name, datums, spelling en bewoording wat jy vir personalisering verskaf, na te gaan voordat jy jou bestelling indien - ons maak dit presies soos aangedui. Indien ons 'n fout maak met die personalisering waarop ons ooreengekom het, neem ons verantwoordelikheid om dit teen ons eie koste reg te maak.

Omdat gepersonaliseerde en spesiaal-gemaakte items net vir jou gemaak word, kan hulle uitgesluit wees van die gewone statutêre afkoelreg waar Suid-Afrikaanse wetgewing dit toelaat. Dit verwyder nie jou regte waar die item gebrekkig is, verkeerd deur ons gepersonaliseer is, of nie ooreenstem met wat jy bestel het nie.

9. Handgemaakte produkte en natuurlike materiale

Alle Handgelaat-produkte is handgemaak - sommige deur ons, en sommige deur die Suid-Afrikaanse makers en verskaffers met wie ons gekies het om te werk. Leer, hout en ander natuurlike materiale is lewende materiale. Hulle kan natuurlike nerf, kleurvariasie, littekens, merke, knoppe en tekstuurverskille insluit. Hierdie eienskappe, en die klein variasies wat met handgemaakte produksie kom, is deel van wat elke stuk uniek maak - dit is nie outomaties gebreke nie.

10. Uitverkoping- en promosieprodukte

Produkte wat op uitverkoping of met 'n promosie-afslag gekoop is, bly ten volle onderhewig aan hierdie Bepalings en Voorwaardes en jou statutêre verbruikersregte, insluitend jou regte rakende gebrekkige, onveilige of verkeerd gelewerde goedere.

11. Privaatheid

Ons neem jou privaatheid ernstig op. Sien asseblief ons Privaatheidsbeleid vir volledige besonderhede oor watter persoonlike inligting ons insamel, hoekom, en hoe ons dit beskerm.

12. Bemarkingstoestemming

Ons stuur slegs bemarkingskommunikasie (soos e-posse oor nuwe produkte of promosies) indien jy vir ons jou toestemming daarvoor gegee het. Jy kan hierdie toestemming enige tyd terugtrek - sien ons Privaatheidsbeleid vir hoe.

13. Intellektuele eiendom

Alle inhoud op hierdie webwerf - insluitend ons naam, logo, produkfotografie, beskrywings en ontwerp - behoort aan Handgelaat (Edms) Bpk of ons verskaffers, en mag nie sonder ons toestemming gekopieer of hergebruik word nie.

14. Toepaslike reg en kontakbesonderhede
